Affordable Housing Ordinance

The purpose of the City's Affordable Housing Ordinance (Title 18, Division 1, Part 6, Chapter 18.155, of the City's Municipal Code) is to foster an adequate supply of housing for all persons at all economic levels, thereby ensuring the preservation of an economically balanced community.

2022 Affordable Housing Ordinance Update

In December 2022, the Fremont City Council voted to update Fremont’s Affordable Housing Ordinance to include a live/work preference policy for City regulated affordable housing developments. The update codifies the City’s longstanding practice to require that affordable housing units required as part of an affordable housing agreement with the City provide a local priority preference for those applying for units. Including the City’s live/work preference policy in the ordinance strengthens the requirement and ensures that this longstanding practice is transparent to all stakeholders. The purpose of the local live/work preference policy for affordable housing units is to remedy or mitigate the displacement and gentrification impacts that may result from development activities and increasing job opportunities in the city. It is designed to increase the probability that current residents can remain in the community despite increasing market rate rents and housing prices. It is also designed to maximize the effect of an improved jobs to housing ratio by increasing local housing opportunities for local employees.
